Piotr Smiechowicz Architecture (PSA) respects your privacy. This notice explains how we collect and use personal information through this website, the contact form, direct emails and initial project enquiries, how long we keep it, who may receive it and the rights available to you.

2 | What this notice covers

This notice applies to visitors to this website and to people who contact PSA about a potential project, collaboration, event, research, teaching or other professional matter. If you later become a client, supplier, collaborator or member of the project team, additional information about project and business records may also apply.

3 | Personal information we collect

We may collect the following categories of personal information:

  • information you provide in the contact form, including your name, organisation, role, work email, telephone number, property or project location, asset or opportunity type, current situation, decision, timing, available information and referral source;

  • information you provide by email or during an initial conversation, including correspondence, project context and indicative commercial information you choose to share;

  • technical and usage information, such as IP address, browser and device information, approximate location, referral source, page views, timestamps, security logs and cookie or consent choices; and

  • professional contact information received through an introduction, collaborator or publicly available business source, such as an organisation's website or professional profile, where relevant to a genuine business enquiry.

The website contact form does not accept file uploads. Please do not include special-category personal data, confidential acquisition information or information belonging to another party unless it is necessary and you are authorised to share it.

4 | How and why we use personal information

We use personal information only where we have a lawful basis and for the purposes described below.

Enquiries and possible appointments

We use your information to answer an enquiry, understand the asset or decision involved, assess whether PSA may be able to help, arrange a conversation and prepare or discuss a proposal. The lawful basis is taking steps at your request before entering into a contract. Where an enquiry is made in a business capacity, by an adviser or about an organisation rather than by the prospective client personally, we may instead rely on our legitimate interests in responding to genuine professional enquiries and developing our business.

Contracts, projects and business relationships

If an appointment or other working relationship develops, we use relevant information to administer the relationship, communicate, provide the agreed services, coordinate with authorised project participants and keep appropriate records. The lawful bases are performance of a contract and our legitimate interests in running the practice and managing professional work.

Website operation, security and abuse prevention

We use limited technical information to operate and protect the website, maintain form and consent functionality, diagnose faults, prevent spam or misuse and investigate security incidents. We rely on our legitimate interests in maintaining a secure and reliable website and, where applicable, compliance with legal obligations.

Analytics

Where optional analytics are enabled, we use them to understand visits, page use and the routes people take through the website. Analytics and other non-essential technologies are used only after the required consent has been given. You can withdraw that consent through Cookie settings.

Legal, professional and insurance requirements

We may use and retain relevant information to comply with legal, tax, regulatory, insurance and professional obligations, and to establish, exercise or defend legal claims. The lawful bases are compliance with a legal obligation and our legitimate interests in protecting the practice and its legal rights.

5 | Marketing

PSA does not currently operate a general newsletter and does not add people who submit website enquiries to a marketing list. If this changes, we will provide clear information and obtain consent where required. You can object to direct marketing at any time.

6 | Cookies and similar technologies

The website uses essential technologies required for security, form operation and remembering privacy choices. Optional analytics, functional or marketing technologies will be used only in accordance with the choices available through the consent tool. Marketing technologies are not intended to be enabled at launch.

7 | Who we share personal information with

We do not sell personal information. Where necessary for the purposes above, information may be disclosed to:

  • Wix.com Ltd. and its relevant group companies and sub-processors, which may provide website hosting, forms, security, customer-management, analytics and consent-management functions;

  • our email, IT, cloud-storage, CRM, anti-spam and cybersecurity providers;

  • architects, consultants, collaborators, advisers or other project participants where this is necessary to assess or deliver a potential or appointed project and appropriate confidentiality arrangements apply;

  • professional advisers, insurers, accountants, auditors and legal advisers; and

  • courts, regulators, tax authorities, law-enforcement bodies or other public authorities where disclosure is required or permitted by law.

Service providers acting as processors may use personal information only for the services they provide to us and in accordance with their contractual and legal obligations.

8 | International transfers

PSA works across the United Kingdom and Poland, and some service providers operate internationally. Information may therefore be processed in the UK, the European Economic Area and other countries. Wix states that site-visitor information may be stored in locations including the United States, Ireland, South Korea, Taiwan and Israel, and in other locations required to deliver its services.

Where data-protection law requires safeguards for a transfer, we rely on an applicable adequacy regulation or decision, approved standard contractual clauses, the UK International Data Transfer Agreement or UK Addendum, or another lawful mechanism. You may ask us for further information about the safeguards relevant to your information by using the privacy contact above.

9 | How long we keep personal information

We keep personal information only for as long as it is reasonably needed for the purpose for which it was collected and for applicable professional, insurance, tax and legal requirements. Our normal approach is:

  • enquiries that do not lead to an appointment are normally kept for up to 24 months after the last meaningful contact;

  • proposal, appointment and project-related records are normally kept for the duration of the relationship and for six years afterwards, but may be kept longer where a contract, professional-indemnity requirement, building-safety rule, tax rule, limitation period, dispute or legal claim justifies it;

  • routine website and security logs are normally kept for up to 12 months, unless they are needed for an active incident, investigation or claim; and

  • analytics, cookie and consent records are kept according to the live tool settings and only for as long as necessary to provide the service, remember a choice, measure the website or demonstrate compliance.

When information is no longer required, it is deleted or anonymised where reasonably practicable.

10 | Security

We use proportionate technical and organisational measures intended to protect personal information against unauthorised access, alteration, disclosure, loss or destruction. Access is limited to people and providers who need it for the purposes described in this notice. No internet transmission or storage system can be guaranteed to be completely secure.

11 | Your rights

Depending on the law and circumstances, you may have the right to:

  • ask whether we process your personal information and receive a copy;

  • correct inaccurate or incomplete information;

  • ask us to delete information where there is no valid reason to keep it;

  • restrict the way information is used in certain circumstances;

  • object to processing based on legitimate interests;

  • receive information you provided in a structured, commonly used and machine-readable format where portability applies; and

  • withdraw consent at any time where processing is based on consent, without affecting processing that took place before withdrawal.

 

YOUR RIGHT TO OBJECT

You may object at any time to the use of your personal information for direct marketing. You may also object to processing based on legitimate interests because of your particular situation. We will stop that processing unless we have compelling legitimate grounds to continue or need the information for legal claims.

 

PSA does not use website or enquiry data to make decisions based solely on automated processing that produce legal or similarly significant effects.

To exercise a right, email contact@piotrsmiechowicz.com. We may need to verify your identity. We normally respond within one month, although the law permits an extension in some circumstances. Rights are not absolute and an exemption may apply.

12 | Complaints

Please contact us first if you have a concern so that we can try to resolve it. You also have the right to complain to a supervisory authority.

This is a professional business website and is not directed at children. We do not knowingly collect personal information from children through the website.

The website may link to external websites, publications, event pages or professional platforms. Those organisations control their own use of personal information. Please read their privacy information before providing data to them.

15 | Changes to this notice

We may update this notice when our services, website configuration, providers or legal obligations change. The current version and its update date will be published on this page. Material changes will be highlighted where appropriate.
